ABSTRACT
The contribution focuses on the way in which the comparative law method is applied by the Court of Justice of the European Union. In so doing, it is argued that method of interpretation and the constitutional traditions common to the Member States go hand-in-hand.
The contribution is divided into two parts. First, the constitutional authority that enables the Court of Justice to engage in a comparative study of the laws of the Member States will be looked at. Second, it shall be examined whether consensus is dispositive in the discovery of constitutional traditions common to the Member States.

REZUMAT
Prezenta contribuție are ca obiect modul în care metoda dreptului comparat este aplicată de Curtea de Justiție a Uniunii Europene. Se susține, în această privință, că metoda amintită de interpretare și tradițiile constituționale comune statelor membre sunt îngemănate.
Contribuția este împărțită în două. În prima parte, este examinată autoritatea constituțională care permite Curții de Justiție să întreprindă un studiu comparativ al legislațiilor statelor membre. În a doua parte, este cercetat dacă, în descoperirea tradițiilor constituționale comune statelor membre, este concludentă existența unui consens.
