The EU’s Contribution to Reshaping the System of Investor-State Dispute Settlement

This paper explores the EU’s role in, and contribution to the various reform processes concerning the international system of investor-state dispute settlement. Starting from an analysis of the current powers of the EU in the field of foreign direct investment, the article approaches the grounds for criticism raised at EU level in respect of the existing ISDS framework. It subsequently discusses the various efforts of the EU to transform ISDS, both within the EU, through a reshaping of the investment protection system after the Lisbon Treaty, as well as on the international plane, through its external agreements and diplomatic involvement. The paper concludes on the transformative influence of the EU in the field of ISDS.

Această lucrare explorează rolul UE şi contribuţia sa la diferitele procese de reformare referitoare la sistemul internaţional de soluţionare a diferendelor investitor-stat. Pornind de la o analiză a puterilor actuale ale UE în domeniul investiţiilor străine directe, articolul abordează motivele criticilor apărute la nivelul UE cu privire la cadrul ISDS existent. Ulterior, se discută despre diferitele eforturi ale UE de a transforma ISDS, atât în cadrul Uniunii, printr-o remodelare a sistemului de protecţie a investiţiilor după Tratatul de la Lisabona, cât şi pe plan internaţional, prin acordurile sale externe şi implicarea diplomatică. Lucrarea concluzionează asupra influenţei transformatoare a UE în domeniul ISDS.
