CEDO și CJUE: Crearea de sinergii în domeniul protecției drepturilor fundamentale*

The text explores the highly influential role that the European Convention on Human Rights, as interpreted by the European Court of Human Rights, has played, and continues to play, in the EU legal order. In so doing, it is stressed the fact that the Charter of Fundamental Rights of the European Union, despite its relative youth, has, in turn, influenced the interpretation of the Convention. That mutual influence has the potential to create synergies between our two Courts that improve fundamental rights protection in Europe as a whole.

Textul explorează rolul foarte mare pe care Convenţia europeană a drepturilor omului, astfel interpretată de Curtea Europeană a Drepturilor Omului, l-a jucat și continuă să îl joace în ordinea juridică a Uniunii Europene. În această privinţă, se subliniază faptul că, în pofida relativei sale tinereţi, Carta drepturilor fundamentale a Uniunii Europene a influenţat, la rândul său, interpretarea convenţiei. Această influenţă reciprocă este de natură să creeze sinergii între cele două instanţe, care ameliorează protecţia drepturilor fundamentale în Europa, în întregul său.
