CJUE și Organul de soluționare al litigiilor al OMC – convergență sau divergențe?

The analysis of the interaction between the European Union legal order and World Trade Organisation (‘WTO’) law would not be complete without a critical assessment of how the European judges and the special groups and the WTO Appellate Body contribute to the articulation between the two legal systems.

Can WTO agreements and rulings of the Dispute Settlement Body (‘DSB’) be invoked before the CJEU? After highlighting the originality of the WTO dispute settlement system (I) vis-à-vis the judicial body of the Union, the study explores the treatment of the direct effect of WTO law in the case-law of the CJEU (II), namely the refusal to use the WTO Agreements to review the legality of acts adopted by the European institutions and the adjustments of this restrictive conception. The rejection of the direct effect of the recommendations and rulings of the DSB (III) will be the subject of particular comments.

Analiza interacțiunii dintre ordinea juridică a Uniunii și dreptul Organizației Mondiale a Comerțului („OMC”) ar fi incompletă fără o evaluare critică a modului în care judecătorii europeni și grupurile speciale și organul de apel al OMC contribuie la articularea dintre cele două sisteme juridice.

Acordurile OMC și hotărârile Organului de soluționare al litigiilor („OSL”) pot fi invocate în fața CJUE? După evidențierea originalității sistemului OMC de soluționare a litigiilor (I) față de jurisdicția Uniunii, studiul explorează tratamentul efectului direct al dreptului OMC în jurisprudența CJUE (II), mai exact a refuzului de a utiliza Acordurile OMC pentru a controla legalitatea actelor adoptate de instituțiile europene, precum și ajustările aduse acestei concepții restrictive. Respingerea efectului direct al recomandărilor și hotărârilor OSL (III) va face obiectul unor observații particulare.
