European Contract Law in the Court of Justice of the European Union Jurisprudence

The article deals with the role played by the Court of Justice of the European Union in „creating norms” in the field of European Contract Law. Three main areas are concerned: defining the scope of application of the instruments of the European Union in the field of European Contract Law; interpreting the concept of the „contract” as a source of rights and obligations; and the procedural framework capable of ensuring the effectiveness of European Contract Law (by establishing the obligation of ex officio application of that body of law).

Articolul abordează rolul exercitat de Curtea de Justiţie a Uniunii Europene în crearea de norme în domeniul dreptului european al contractelor. Sunt vizate trei mari domenii: definirea domeniului de aplicare al instrumentelor Uniunii Europene în materia dreptului european al contractelor; interpretarea noţiunii „contract”, ca izvor de drepturi şi obligaţii; respectiv cadrul procedural susceptibil să asigure efectivitatea dreptului european al contractelor (prin instituirea obligaţiei de aplicare din oficiu a acelui corp normativ).
